The State of New Jersey is the first state to take action against the national drinking water crisis by implementing new regulations. On September 4, 2018, the New Jersey Department of Environmental Protection (NJDEP) adopted amendments to the New Jersey Safe Drinking Water Act rules and the Private Well Testing Act (PWTA).
The Safe Drinking Water Act rule changes include the establishment of two new Maximum Contaminant Levels (MCLs) of 0.013 micrograms per liter (μg/l) for perfluorononanoic acid (PFNA) and 0.030 μg/l for 1,2,3-trichloropropane (1,2,3-TCP). In addition, there are new monitoring requirements for PFNA, 1,2,3-TCP and radionuclides (gross alpha and uranium). With these changes, New Jersey becomes the first state to set an MCL for PFNA and the third to set an MCL for 1,2,3-TCP.
The new Private Well Testing Act rules effective September 4th specifically mandate the testing of arsenic and gross alpha in all counties. Uranium is a new parameter and is required in 12 northern counties throughout the State of NJ. In addition, the PWTA amendments require the inclusion of 1,2,3-TCP, ethylene dibromide (EDB) and 1,2,-dibromo-3-chloropropane (DBCP) that will be effective on March 3, 2019.
