Title EPA Reaches Costly Settlement with Residential Contractor for Failing to Follow Lead-Safe Work Practices
Introduction EMSL Analytical offers laboratory testing services, sampling supplies, test kits and personal protective equipment to identify and mitigate environmental exposure risks to protect people and to help companies comply with health and safety regulations.

Cinnaminson, New Jersey, March 1, 2024

Last month, the U.S. Environmental Protection Agency (EPA) announced it had reached a settlement with a Connecticut-based residential contractor for violations of the federal lead Renovation, Repair, and Painting (RRP) Rule. As a result of the settlement, the business has agreed to pay a penalty of over $34,000 and certify compliance with the RRP Rule.

According to the agency, after observing that the company failed to follow lead-safe work practices at one residence, EPA performed an audit of the company's business records. A sample of six renovation projects that the business subcontracted over the previous two years was used to evaluate the company's compliance with the RRP Rule. Based on a review of those records, EPA alleged that the company violated the RRP Rule 15 times during six renovation projects in the period audited. The location of one of the renovation projects cited is in an area of environmental justice concern. That inspection was part of EPA New England's Connecticut Geographic Initiative for lead-based paint.

“Contractors and painters need to be aware that there have been a number of cases brought against these types of businesses by EPA over lead issues in recent times,” said Joe Frasca, Senior Vice President of Marketing at EMSL Analytical, Inc. “To help business owners and managers, EMSL Analytical has laboratories across North America that provide environmental, material and industrial hygiene testing services for lead, asbestos and other regulated substances. We also offer sampling supplies, easy-to-use test kits, air monitoring instruments and personal protective equipment. These services and resources can be essential for protecting workers and the public from needless exposure risks. They are also key components of effective health and safety programs to keep companies in regulatory compliance.”
