Title Real Estate Development and Management Companies Agree to EPA Penalties to Resolve Alleged Asbestos Violations
Introduction EMSL Analytical provides environmental, material and industrial hygiene testing services to identify and mitigate asbestos exposure risks while helping companies comply with health and safety regulations.

Cinnaminson, New Jersey, May 16, 2024

Last month, the U.S. Environmental Protection Agency (EPA) announced that it had taken action against a property management firm and a real estate development company based Rhode Island. The agency claims the businesses violated Clean Air Act (CAA) asbestos reporting requirements and the National Emission Standard for Hazardous Air Pollutants for asbestos regulations (Asbestos NESHAP).

According to the EPA:

The Asbestos NESHAP requires owners and operators of demolition and renovation operations to thoroughly inspect a facility for asbestos prior to starting any work. It also requires them to provide written notice to the appropriate regulatory agency before renovation activities involving Regulated Asbestos Containing Material (RACM) at or above certain threshold amounts, or demolition activities begin regardless of whether the facility is believed to contain RACM. Performing the work in accordance with the Asbestos NESHAP helps to ensure that areas in use during the renovation are not contaminated and that the area under renovation or demolition, when it is complete, is also free of contamination.

“Under this settlement, the businesses will pay a penalty of almost $25k to resolve the allegations,” said Joe Frasca, Senior Vice President, Marketing at EMSL Analytical, Inc. “Companies need to be aware of asbestos regulations to not only protect workers and building occupants, but to also protect their reputation and to avoid costly noncompliance penalties.”

To assist in this effort, EMSL Analytical has asbestos testing laboratories located across North America to help contractors, companies, property owners, property managers, real estate developers and environmental professionals test for asbestos. They also offer sampling supplies, personal protective equipment and a wide range of air sampling instruments. These services and resources help to protect against exposure risks and can be instrumental for keeping companies in compliance with asbestos regulations.
