Title EPA Fines Property Management Company for Alleged Federal Lead Disclosure Rule Violations
Introduction EMSL Analytical offers comprehensive environmental, material and industrial hygiene testing services, sampling supplies and test kits to identify toxic heavy metals and other exposure hazards in all types of properties.

Cinnaminson, New Jersey, July 26, 2024

Last month, the U.S. Environmental Protection Agency (EPA) announced it had reached a settlement with a Connecticut-based property management company and two property owners for alleged violations of the Lead Disclosure Rule. Under the terms of the settlement, a combined penalty of over $39,000 will be paid.

According to the EPA:

The Disclosure Rule requires sellers, landlords, and agents to provide potential buyers and renters of housing built before 1978 information about lead-based paint and lead-based paint hazards in the residence prior to becoming obligated to buy or rent the housing and provides the opportunity for an independent lead inspection for buyers. Sellers, landlords, and agents are responsible for compliance.

“This case is a reminder for property management companies and real estate professionals to maintain compliance with existing regulations as people buying, renting or leasing a property need to know about lead-based paints and the dangers they can present,” said Joe Frasca, Senior Vice President, Marketing at EMSL Analytical, Inc. “Tenants and home buyers of older properties have a legal right to know if their unit or house has lead-based paints. At EMSL, we have dozens of laboratories across North America that identify lead exposure risks to protect people and businesses. We offer rapid lead testing services, sampling supplies, easy-to-use test kits and even personal protective equipment to safeguard against exposure hazards. These quick and affordable testing resources can provide answers about lead in paint, dust, soil and even water.”

EMSL sponsored an educational video about homebuyers and lead disclosures a number of years ago that can still be seen at: https://youtu.be/rhsyyj7nMeQ
