Last month, the U.S. Environmental Protection Agency (EPA) announced it had issued a notice of violation under the Toxic Substances Control Act (TSCA) to a public charter school management organization for asbestos and lead paint concerns. The notice involved three of its public charter schools in Ohio that may present hazards to students, faculty and staff.
The school operator has been instructed to investigate the risk of exposure to lead-based paint and asbestos hazards, address materials which pose an imminent danger, and monitor any other asbestos-containing material and lead-based paint at the three schools. EPA is also requiring them to prohibit anyone from entering affected areas until abatement work is finished.
“In this instance, Ohio state officials conducted a visual inspection shortly after receiving a complaint and notified EPA of their findings due to the agency’s authority under the Asbestos Hazard Emergency Response Act,” said Joe Frasca, Senior Vice President, Marketing at EMSL Analytical, Inc. “EPA then conducted their own visual inspection of the three schools and discovered they did not have asbestos management plans.
